Everything on this website is general information about XTM Construction, LLC and the kind of work we do. It is written to help you decide whether to contact us. It is not advice about your specific property, your specific problem, or your specific budget, and it should not be treated as a substitute for having someone competent look at the actual building.
We try to keep the site accurate and current. We do not warrant that it is complete, error free, or up to date at any given moment. Prices, availability, service areas, materials, and code requirements change.
2Not engineering, architectural, or legal advice
Nothing on this site is engineering advice, architectural design, structural analysis, geotechnical opinion, industrial hygiene assessment, insurance advice, or legal advice.
- Structural, foundation, and drainage decisions should be based on an evaluation by a Texas licensed professional engineer. We will tell you when your project needs one, and we will not substitute our judgment for theirs.
- Design work requiring a licensed architect will be performed by one where the law requires it.
- Mold, asbestos, and lead work requires licensed assessment and clearance testing separate from the remediation itself, and Texas rules generally require the assessor and the remediator to be independent of each other.
- Whether your insurance covers a loss is between you and your carrier. We can document damage and scope repairs, but we do not adjust claims, and nothing we say about coverage binds your insurer.
- Nothing on this site is legal advice about your contract, your rights, or your options. Talk to a Texas attorney.
3No guarantee of outcome
Construction happens on real buildings with real histories, and every property is different. Nothing on this site is a promise that your project will cost a particular amount, take a particular length of time, produce a particular result, increase the value of your property, reduce your utility bills by a particular amount, or resolve a problem permanently.
Statements about our experience, the number of projects we have completed, and our approach to work describe our record. They are not a warranty of future performance on your project. Your project is warranted by the written limited warranty delivered with your contract.
4Photographs and project images
Images on this website are shown to illustrate the type and quality of work we do. Unless a caption says otherwise, you should assume the following.
- Images may show work performed by XTM Construction, by our subcontractors, or by trade partners working under our supervision.
- Some images are stock or reference photography used to illustrate a service category rather than a specific job we performed.
- Images may be staged, styled, edited for color and lighting, or cropped.
- Finishes, fixtures, materials, and layouts shown are examples and are not included in any estimate unless your written proposal lists them.
- Before and after pairs represent the specific property shown and are not a prediction of what your property will look like.
5Estimates, ranges, and the request form
The budget ranges and service categories in our request form exist to help us route your request to the right person. They are planning aids. Selecting a range is not a commitment by you, and displaying one is not an offer by us. No price is binding until it appears in a written proposal signed by both parties.
Submitting a form does not reserve a place in our schedule, does not create a contract, and does not obligate us to perform work. We will follow up to discuss what you need.
6Schedules, weather, and supply
Timelines we discuss before a contract are estimates. Construction schedules in South Texas move for reasons outside anyone's control, including heat, rain, freeze events, permit and inspection backlogs, utility scheduling, material lead times, and conditions discovered once a wall or a slab is opened up. We will tell you promptly when a schedule changes and why.
7Reviews and testimonials
Any customer review or testimonial shown on this site reflects the experience of that individual customer on that individual project. Results vary. We do not pay for reviews, and we do not offer discounts, gifts, or other compensation in exchange for a positive one. We do not edit the substance of a review, and we do not suppress negative reviews on platforms we do not control.
8Statements about licensing and insurance
Texas does not issue a general contractor license. When this site says we are licensed and insured, it means the regulated trades on your project are performed by individuals or subcontractors holding the applicable Texas trade license, and that XTM Construction, LLC carries commercial general liability insurance. The specific licenses and coverage are listed in the Terms of Service and a current certificate of insurance is available on request. Coverage described anywhere on this site is the coverage in force on the date of the statement.

Links to other websites, manufacturer pages, social media, and third party resources are provided for convenience. We do not control them, do not endorse them by linking to them, and are not responsible for their content, accuracy, availability, or privacy practices. Follow them at your own discretion.
10The website itself
This website is provided on an as is and as available basis. To the fullest extent permitted by law, XTM Construction, LLC disclaims all warranties relating to the website itself, including implied warranties of merchantability, fitness for a particular purpose, and non infringement, and does not warrant that the site will be uninterrupted, timely, secure, or free of errors or harmful components. Your use of the website is at your own risk.
To the fullest extent permitted by law, we are not liable for any damages arising out of your use of, or inability to use, this website, including lost data, lost profits, or business interruption.
11What this disclaimer does not do
This is the part most disclaimers leave out, so we are putting it in plain language. The paragraphs above are about this website. They do not reach the construction work, and several protections Texas gives you cannot be disclaimed by anyone, including us.
- The implied warranty of good and workmanlike performance and the implied warranty of habitability cannot be waived by general contract language under Texas law, and we do not attempt to waive them. Our written express warranty defines the standard of quality for the work it describes, which is what Texas law permits.
- The Residential Construction Liability Act, Chapter 27 of the Texas Property Code, applies to residential construction defect claims. Section 27.009 makes an attempted waiver of that chapter void. Nothing here waives it.
- Your rights under the Texas Deceptive Trade Practices Act are not waived by this site or by our contract. A waiver of those rights is void unless you are separately represented by your own attorney, and it can never bar an action by the Texas Attorney General.
- Nothing here limits liability for death or personal injury, for gross negligence, or for fraud or intentional misconduct.
- Nothing here shortens a statutory notice period, a limitations period, or a statute of repose in your favor.
12Governing law
This disclaimer is governed by the laws of the State of Texas. Disputes are handled as described in the Terms of Service, which provides for individual arbitration seated in Bexar County, Texas, after the statutory notice procedures described there have been completed.
